Effective date: [EFFECTIVE DATE].
These Bidder Terms of Sale apply every time you register, bid on, win or pay for a lot on Magnolia Online Auctions (“Magnolia”, “we”, “us”). By placing a bid you agree to them. Please read them together with our Terms of Use and Privacy Policy.
Lots on Magnolia are offered by independent sellers (“Sellers”), each shown by store name on the auction and lot pages. Magnolia runs the website and the bidding system. When you win a lot, your purchase is from the Seller of that lot.
When a lot closes, the highest bid that meets any reserve wins. We will email you and list the lot under My Account → Won. The amount you owe for each lot is:
You pay for your lots at pickup, directly to the Seller. Each Seller lists the payment methods they accept (for example cash or card) in the pickup details for their auction. Lots must be paid for in full before they are released to you. We do not take payment online at this time.
All lots are sold “as is, where is”, with all faults. Sellers describe and photograph their lots in good faith, and some descriptions are prepared with the help of automated tools, but descriptions, measurements, dates and attributions are opinions, not guarantees. Where an auction offers a preview, please inspect lots before bidding. Neither Magnolia nor the Seller gives any warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose, except where the law does not allow this to be excluded.
All sales are final. [OPTIONAL: If a lot is materially different from its description, tell the Seller before you pay and before you take the lot; the Seller may then cancel that lot’s sale.]
Winning a lot and not paying or not collecting it harms Sellers and other bidders. If this happens we may cancel the sale, offer the lot to another bidder, suspend or close your account, and block you from future auctions. [CONFIRM: any non-payment fee.]
Some categories, such as firearms, ammunition, knives and other weapons, are subject to federal, state and local laws. By bidding on such a lot you confirm that you may lawfully buy and own it. The Seller may require proof of eligibility and identity before release, and will refuse release where the law requires. [CONFIRM: how firearm transfers are handled, for example through a licensed dealer (FFL), and any items Magnolia does not allow at all.]
To the fullest extent the law allows, Magnolia’s total liability to you for any lot is limited to the buyer’s premium you paid on that lot, and we are not liable for indirect or consequential losses. Disputes about a lot’s condition, payment or pickup are between you and the Seller, although we will try to help resolve them.
We may update these terms from time to time. The version shown when you place a bid applies to that bid.
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the courts of [COUNTY] County, Florida.
